The Ministry of Industry and Information Technology ("MIIT") has recently issued the Implementing Rules for Complaints about, Investigations into and Handling of Radio Interference (the "Rules"), immediately effective from the date of issuance.
The Rules stipulate that, radio interference is rated in three different classes. Class I radio interference refers to the radio disturbance which endangers the national security, public security, security of life and property and which affects the normal radio frequencies used for major events. Class II radio interference means the radio disturbance that has serious impacts on radio business legally conducted by important users, including party and government organs, civil aviation departments, radio and television authorities, and water business authorities. And Class III radio interference covers radio disturbance of other types. The Rules clearly state that all provincial radio regulators and the State Radio Monitoring Center shall start their work upon receipt of tasks of probing into radio disturbance, depending on the class of the reported disturbance. In case of a task to investigate the Class I radio disturbance, they shall take immediate measures to monitor the disturbance upon receipt of such task, and complete the monitoring process and report the monitoring results within three days. In addition, the Rules require that various radio monitoring equipment used to collect monitoring data should be tested and certified regularly to ensure the accuracy of monitoring data.
