Eight departments, including the National Health Commission ("NHC"), have recently issued the Plan for the Special Rectification Action Against Medical Chaos (the "Plan").
According to this Plan, a one-year special action will be launched, from March this year till the end of February 2020, to rectify and clear away chaotic situations in the healthcare industry. This action will cover but not be limited to: 1. severely cracking down upon various illegal and unlawful medical practices; 2. severely clamping down on swindles of medical insurance benefits; 3. seriously investigating and combating acts of placing unlawful medical advertisements and publishing fake medical information; and 4. resolutely investigating and punishing acts of illegally charging fees, charging unapproved fee items, luring into consumption and offering excessive and unnecessary diagnosis and treatment services. Among others, the Plan states that severe crackdown will be launched on physicians' leasing, lending and transfer of their Practicing Permits for Physicians, medical institutions' buying, selling, transfer, leasing and lending of their Practicing Licenses for Medical Institutions or Practicing Permits for Physicians, practicing medicine without permits, unlawfully performing the immunotherapy, deceiving, inducing or compelling patients to, with the aid of medical scalpers or by means of false diagnosis, receive diagnosis and treatment or consume services or products, and illegally obtaining, buying or selling organs, corneas and other human tissue and organs.
