The Ministry of Transport ("MOT") has recently drafted and issued the Administrative Provisions on the Sharing and Operation of Navigational Instruments of Civil Aviation (Draft for Comment) (the "Draft for Comment") for public consultation by June 18, 2019.
According to the Draft for Comment, the amended statute highlights changes in eleven aspects. First, its structure is adjusted. Second, the sharing and operation of navigational instruments of general aviation will be managed by class. Third, local authorities' power in examination and approval is adjusted. Fourth, approaches adopted to manage the sharing for special purposes are adjusted. Fifth, the application criteria and the application materials are simplified. Sixth, provisions in respect of regular sharing are revised. Seventh, provisions on instrument shutdown are amended. Eighth, technical discussions and verification are modified. Ninth, articles setting out requirements for electromagnetic environment and flight procedure operators are added. Tenth, provisions regarding the sharing and operation of navigational instruments of general aviation are introduced. And last, a new chapter on supervisory checks is added. The Draft for Comment removes a previous requirement among the application criteria that the radio band or the radio station's address has been approved for the instrument, and meanwhile, removes accordingly the previously-requested approval document for the radio band or the radio station's address and approval document for the instrument's frequency and call signs, out of the list of application materials.
