The General Office of the National Development and Reform Commission ("NDRC") has recently issued the Guidelines for Criteria of Disclosure of Grassroots-level Government Affairs in the Realm of Public Resource Transactions (the "Guidelines").
The Guidelines state that: 1. These guidelines apply to work on disclosure of government affairs in relation to public resource transactions, conducted by administrative bodies at or below the county (district or prefecture) level that perform duties related to public resource transactions and by organizations or public enterprises and institutions empowered by laws and regulations to carry out the administrative roles over public affairs; 2. According to the requirement of making public five types of information on decision-making, execution, management, services and results, the catalog of disclosure criteria enumerates 40 specific items subject to disclosure in relation to public resource transactions in five aspects, namely tendering and bidding of engineering construction projects, government procurement, granting of the right to use state-owned land, granting of the mining right, and trading of state-owned property rights, and each region may introduce extra items subject to disclosure, in light of the local actualities; 3. Each region should lose no time in drawing up and launching the local catalog of government information on public resource transactions to be voluntarily disclosed or revising the existing catalog, publishing it in a prominent position on the website and in the site for public resource transactions, and having it adjusted dynamically.
