Recently, the China Insurance Regulatory Commission has drafted the Measures for the Pilot Record-filing Administration of Professional Insurance Agency Operations across Beijing-Tianjin-Hebei Region (Draft for Public Comment) (the "Draft for Comment") and the Measures for the Pilot Record-filing Administration of Insurance Company Operations across Beijing-Tianjin-Hebei Region (Draft for Public Comment) for public comments before December 9, 2016.
The Draft for Comment expressly states that after a national legal person insurance agency that is registered in the Beijing-Tianjin-Hebei Region has filed a record with the regulatory department of insurance, it may, without establishing a branch, carry out insurance agency services outside the place where it is registered with the industry and commerce authority across the Beijing-Tianjin-Hebei Region. According to the Draft for Comment, where a professional insurance agency operates across the Beijing-Tianjin-Hebei Region, it shall satisfy four conditions, one of which is that "the agency commissions obtained in the preceding year exceeds CNY5 million. Moreover, it also provides for six circumstances of mandatory exit, one of which is that "it does not establish a branch outside the place where it is registered with the industry and commerce authority, but provides insurance agency services for individual clients".
