Lately, the National Development and Reform Commission ("NDRC") has issued the Administrative Measures for the Credit of Public Resource Trading (Draft for Comment) (the "Draft for Comment") for public comments before March 21, 2017.
The Draft for Comment applies to the recording, collection, publication, sharing and application of credit with regard to public resource trading. It provides that the administrative regulators shall take the initiative to disclose certain information on parties involved in public resource trading activities to the public, including their basic information, uniform social credit code, title of any award as well as certifications for such award, name of any discipline, the handling decision, time of handling, duration of such discipline, information on their commitment, and implementation of such discipline. Further, the Draft for Comment makes it clear that where there is a record of discipline for any party involved in a public resource trading activity, such measures as "considering it as a target under key supervision and inspection and increasing the frequency of inspections" shall be taken against it. Additionally, the Draft for Comment stresses that the parties concerned providing false credit information on public resource trading shall be handled by relevant department according to regulations; and the information on how such parties are handled shall be made public through the service system for the public resource trading platform; and the parties concerned shall be transferred to a judicial organ if they are suspected of committing any crime.
