Recently, the revised version of the Law of the People's Republic of China on the Red Cross Society (Revised in 2017) (the "Law on the Red Cross Society") has been voted and adopted at the 26th Session of the Standing Committee of the 12th National People's Congress and issued upon Order of the President No.63 for implementation as of May 8, 2017.
The Law on the Red Cross Society, organized into seven chapters with a total of thirty articles, covers the organization, responsibilities, marks and names, property and regulation, legal liability and other contents. The Law on the Red Cross Society puts emphasis on the enhanced regulation over the Red Cross Society, requiring that the Red Cross Society shall establish systems in respect of financial management, internal control, auditing disclosures, and supervision and inspection, retain a legally incorporated independent third-party institution in a timely manner to audit both the income derived from donated funds and materials and particulars on its use, and announce such income form donated funds and materials as well as details on its use to the public on a uniform information platform. Moreover, the Law on the Red Cross Society includes a new separate chapter to clarify legal liabilities of the Red Cross Society, and introduces certain responsibilities of the Red Cross Society in promoting body donation and other aspects.
