The Ministry of Industry and Information Technology ("MIIT") has recently issued the Implementing Rules of the Administrative Regulations of the People's Republic of China on Controlled Chemicals (Revised Draft for Comment) (the "Draft for Comment") for public consultation by April 13, 2018.
The Draft for Comment introduces major amendments in the following respects. The first is adjusting the wording concerning the competent authorities of controlled chemicals. The second is optimizing provisions in respect of conditions and procedures for administrative licensing. The third is improving the rules that shall be observed by manufacturers, users and dealers of Class II controlled chemicals in the stage of manufacturing, use, sales, change of the line of production, and production suspension. The fourth is optimizing the data reporting system for controlled chemicals, and adding rules on requirements for safekeeping records relating to Class II, Class III and Class IV controlled chemicals as well as the record retention term. The fifth is introducing relevant rules on international inspection visits, and making clear the legal liability for refusing to perform their obligations in international inspection visits or to cooperate in international inspection visits. And the last is removing provisions regarding the storage and transport of controlled chemicals.
