Lately, the National Health Commission ("NHC") and the State Drug Administration ("SDA") have jointly issued the Administrative Measures for Allocation and Use of Large Medical Facilities (for Trial Implementation) (the "Measures"), and the NHC also released the Implementing Rules for the Administrative Licensing for the Allocation of Class-A Large Medical Facilities, both of which take effect immediately from the issue date.
The Measures, comprised of 49 articles in seven chapters, are intended to standardize the whole-process administration of large medical facilities, ranging from the determination of the administrative catalog, preparation of the allocation planning, license implementation, use, to supervision and administration. According to the Measures, there are two types of administrative catalogs for the allocation of large medical facilities, respectively for Class A and Class B large medical facilities. The NHC is in charge of allocating and administering Class A large medical facilities and issuing the allocation licenses for the same, while provincial health administration departments are responsible for allocating and administering Class B large medical facilities and issuing the allocation licenses for the same. Furthermore, the Measures provide that the allocation planning for large medical facilities shall be prepared every five years and implemented by year. In the allocation planning for large medical facilities, those facilities to be allocated for the first time should be capped at five in principle, and the facilities sourced from a single manufacturer shall be three at the maximum.
