The Ministry of Emergency Management ("MEM") has recently issued the Circular on Comprehensively Implementing the Safety Risk Assessment and Commitment Announcement System for Hazardous Chemicals Enterprises (the "Circular").
The Circular applies to enterprises manufacturing or operating (with storage facilities) hazardous chemicals and those obtaining licenses for the safe use of hazardous chemicals. The Circular requires the establishment of a safety risk assessment system, with the key contents including four aspects, such as "safe operation status of production equipment", "safe operation status of major hazard sources such as hazardous chemicals tank areas and warehouses", and "safety risk controllable status of high-risk production activities and operations". According to the Circular, a safety commitment announcement covers two parts of contents, namely the enterprise status and the enterprise safety commitment. Enterprise falling under any of the four circumstances, such as "failing to establish a sound safety risk assessment and commitment announcement management system and have the relevant responsibilities implemented at all levels", shall not issue their safety commitment announcements to the public.
