Lately, the Ministry of Housing and Urban-rural Development("MOHURD") has promulgated the Code of Conduct for Law Enforcement in Urban Management ("Code of Conduct"), with effect from October 1,2018.
The Code of Conduct stipulates that urban management law enforcement personnel should perform their duties in accordance with the statutory authority, scope, procedures, and time limits, and shall not have six kinds of behaviors including "selective enforcement of law" .The Code of Conduct requires that urban management law enforcement personnel should record the whole process of such law enforcement by means of texts, audios and videos and so on to realize backtracking management. The urban management law enforcement personnel shall investigate and collect evidence lawfully, comprehensively, objectively and fairly. In the course of investigation and evidence collection, the number of urban management law enforcement personnel shall not be less than two. It is set forth in the Code of Conduct that urban management law enforcement personnel shall register and preserve the evidence in advance, or seal up venues, facilities and seize property in accordance with the law. The urban management law enforcement personnel shall keep the property registered or preserved or seized in advance in good custody, and shall not use, intercept, damage or dispose of the aforesaid property without authorization.
