The State Administration for Market Regulation ("SAMR") has recently issued the Licensing Rules for Special Equipment Manufacturers (Draft for Comment) (the "Draft for Comment") for public consultation by March 3, 2019.
The Draft for Comment provides that authorities granting licenses for special equipment include the SAMR and the departments of provincial-level governments that are responsible for the supervision of special equipment safety. The licensing covers the licensed class, licensed items and approved parameter levels. The Draft for Comment expressly states that, an entity applying for a license for special equipment manufacturing or filling shall hold the legal qualification, have in place resources and conditions, such as technical professionals, workplaces, and equipment and facilities, that are appropriate to the licensed scope, establish and effectively put into practice systems concerning quality assurance, safety management and job accountability that are appropriate to the licensed scope, and are technically capable of ensuring the substantial safety of its products. Moreover, the Draft for Comment states that, there are two types of licenses, namely the License of the People's Republic of China for Special Equipment Manufacturers and the License of the People's Republic of China for Entities Filling Mobile Pressure Vessels (Gas Cylinders), both valid for five years.
