The State Council has recently distributed the Opinions on Fully Promoting the Interdepartmental Joint Regulation under the "Dural Randomness and One Publicity" Mode in the Field of Market Regulation (the "Opinions").
The Opinions state that, by the end of 2020, the "dual randomness and one publicity" regulation mechanism will involve all relevant departments in the field of market regulation, and relevant departments under all levels of local governments will regularly carry out joint regulatory activities under the "dual randomness and one publicity" mode at that time, adding that the country will strive to make this new regulation mechanism more thorough in the market regulation area and realize comprehensive and smart regulation, in three to five years. Accordingly, the Opinions outline several key tasks in seven aspects, including "building regulation platforms via overall efforts", "managing inspection items by list" and "creating and improving 'two' databases (representing the database of inspected targets and the database of inspectors) for random inspections". Among others, the Opinions clarify that all relevant departments shall, pursuant to laws, regulations and rules, come up with their own list of items to be examined during random inspections, and make clear the basis of their inspections, subjects involved in the inspections, coverage of the inspections, and ways in which the inspections will be conducted. All provincial governments shall make overall efforts to establish and optimize the database of inspected targets and the database of inspectors that cover targets and inspectors at different levels within their respective jurisdiction and fit the inspection items.
