The State Administration for Market Regulation ("SAMR") has recently drafted and issued the Interim Measures for Revoking Enterprise Registration Made with the Illegal Use of Identity Information of Others (Draft for Comment) (the "Draft for Comment") for public consultation by April 28, 2019.
The Draft for Comment clarifies that after receiving a complaint lodged by an individual that his or her identity information is illegally used, the registry office shall make public, within seven working days, particulars of the concerned company's alleged illegal use of identity information for the registration purpose through the National Enterprise Credit Information Publicity System. According to the Draft for Comment, the aforesaid particulars shall include when the problematic registration was made, as alleged by the complainant, the registration or record-filing items involved, etc., and be made open to the public for a period of six months. Where an investigation comes to an end with a conclusion within such period, the publicity will be discontinued but be kept on record. Moreover, the Draft for Comment sets out the conditions under which registry offices may make decisions to revoke the registration or record-filing made by enterprises.
