The Ministry of Transport ("MOT") has recently issued the Decision on Revising the Rules of the People's Republic of China on Safety of Port Facilities (the "Decision") and the Decision on Revising the Rules of the People's Republic of China on Safety of International Vessels, both of which have gone into effect immediately from the date of issuance.
The Decision removes the third item under Article 4 of the Rules on Safety of Port Facilities; adds to items under Article 5 a new one, numbered Item 1 and reading: "1. Granting the Compliance Certificates for Safety of Port Facilities"; and adding one more type of information, i.e. "types of vessel to which services may be delivered", following the "owners", to the basic information that is required to be provided in the first item under Paragraph 2 of Article 22. Meanwhile, the Decision replaces the term "Ministry of Transport" in Article 37 with "the provincial-level administration of transport (port)", removes "the Safety Plan for Port Facilities" in the third item under this paragraph, and revises the fourth item to read: "the Safety Plan for Port Facilities and the examination opinions issued by the administrative department of ports at its place". Moreover, the Decision introduces modifications to Article 38, Article 45 though Article 47, Article 75, etc.
