The Supreme People's Procuratorate ("SPP") has recently distributed the Decision on Repealing the Interpretations of the Supreme People's Procuratorate on Several Issues concerning the Specific Application of Law in Handling Criminal Cases Involving Illegal Edible Salt Operations (the "Decision"), with effect from April 1, 2020.
The Decision clearly states that the SPP has decided to repeal the Interpretations of the Supreme People's Procuratorate on Several Issues concerning the Specific Application of Law in Handling Criminal Cases Involving Illegal Edible Salt Operations. After the interpretations are repealed, the procuratorial organs may, pursuant to the provisions of the Interpretations of Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Specific Application of Law in Handling Criminal Cases Involving Illegal Production or Sale of Fake or Substandard Commodities and the Interpretations of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Application of Law in Handling Criminal Cases of Endangering Food Safety, pursue the criminal liability of the criminals that sell non-iodized salt in the name of iodized salt or non-edible salt such as industrial salt in the name of edible salt or commit other acts that undermine salt safety, under the crime of producing and selling fake or substandard commodities, the crime of producing and selling food not up to food safety standards, or the crime of producing and selling poisonous and harmful food, as appropriate.
