Administrative Measures for the Examination and Approval of Wholly Foreign-owned Shipping Service Companies (Revised in 2015)

(Promulgated by the Ministry of Communications and the Ministry of Foreign Trade and Economic Cooperation on January 28, 2000 and amended in accordance with the Decision on Revising the Interim Administrative Measures for the Examination and Approval of Wholly Foreign-owned Shipping Service Companies issued by the Ministry of Transport and the Ministry of Commerce on July 5, 2015)

Article 1 In order to standardize the investment and business activities of foreign shipping companies in the People's Republic of China and protect the legitimate rights and interests of investors, the Administrative Measures for the Examination and Approval of Wholly Foreign-owned Shipping Service Companies (hereinafter referred to as the "Measures") are formulated in accordance with the laws of the People's Republic of China on foreign-invested enterprises and the relevant shipping regulations.

Article 2 The Measures shall apply to the wholly-owned companies established in China by foreign shipping companies.
For the purpose of the preceding paragraph, the term "foreign shipping companies" refers to the shipping enterprises established in foreign countries in accordance with the laws thereof (hereinafter referred to as the "foreign shipping carriers").

Article 3 The Ministry of Commerce of the People's Republic of China (hereinafter referred to as the "MOFCOM") and the Ministry of Transport are in charge of examining and approving the wholly-owned shipping service companies established in China by foreign shipping carriers.

Article 4 The wholly-owned shipping service companies established in China by foreign shipping carriers shall be subject to examination and approval in accordance with the maritime agreements concluded by the Chinese government and the governments of countries where the foreign shipping carriers are located and related legal documents.

Article 5 To establish a wholly-owned shipping service company, an applicant must meet the following conditions:
