Several Opinions of the State Council on Accelerating the Construction of Great Power in Intellectual Property Rights Industry under the New Situation

The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government; all ministries and commissions of the State Council and all institutions directly under the State Council,
Since the implementation of national intellectual property strategy, the level of creation and application of intellectual property in China has risen significantly with obvious improvement of protection situation, intellectual property awareness in the whole society has been universally enhanced, considerable progress has been achieved in intellectual property-related work and intellectual property has played an important role in the economic and social development. Meanwhile, China still faces with such problems to be researched and resolved as the intellectual property is big but not strong, many but of low quality, under insufficient protection, subject to prone and frequent infringement with the passion of innovation and entrepreneurship affected. Currently, as a new round of global scientific and technological revolution and industrial reform is ready to launch, China accelerates the transformation of economic development mode, the innovation-guided development trend becomes more obvious and the basic guarantee function that intellectual property system encourages innovation becomes more prominent. In order to further implement the strategy of innovation-driven development, deepen the reform in the field of intellectual property and accelerate the construction of great power in intellectual property rights, the Opinions are hereby proposed as follows:
I. General Requirements
(I) Guidelines. Fully implement the guidelines of the 18th National Congress of the Communist Party of China (CPC) and the Second, Third, Fourth and Fifth Plenary Sessions of the 18th CPC Central Committee and in accordance with the requirements of the strategic layout of "four comprehensives" and the decisions and arrangements of the CPC Central Committee and the State Council, further implement the national intellectual property strategy, deepen the reform in major fields of intellectual property, effectively promote the creation and application of intellectual property, implement stricter protection of intellectual property rights, optimize public services on intellectual property, promote prosperous development of new technologies, industries and business-forms, raise the development level of internationalization of industries and guarantee and encourage mass entrepreneurship and innovation to provide strong support to the implementation of the strategy of innovation-driven development and lay a more stable foundation for the promotion of maintaining middle and high-speed economic growth, moving towards middle and high-end economic level and the achievement of "Two Centenary" goals and the Chinese dream of bringing about a great rejuvenation of the Chinese nation.
(II) Basic principles.
Adhere to strategic guidance. In accordance with such strategies and arrangements as innovation-driven development and "One Belt One Road", drive the enhancement of the ability to create, apply, protect, manage and serve intellectual properties, deepen the implementation of intellectual property strategies, promote intellectual property quality to achieve the transformation from big ones to strong ones, and from many ones to high-quality ones and implement a new round of high-level opening-up to promote the continuous and healthy development of economy.
Adhere to reform and innovation. Accelerate the improvement of intellectual property system with Chinese characteristics, reform the innovation system and mechanism, remove the obstacles that restrict the development of intellectual property industry, focus on the promotion of the test on innovation reform, enhance the knowledge value orientation of distribution system, give full play to the key role of intellectual property system in the encouragement of innovation and promotion of reasonable sharing of innovative achievements and promote the quality improvement, efficiency increase of enterprises and transformation and upgrading of industries.
Adhere to market orientation. Give play to the decisive role of the market in allocation of innovation resources and enhance the dominant position and orientation function of enterprise innovation, promote the reasonable flow and efficient allocation of elements of innovation. Accelerate the administration streamlining and power delegation, combination of power delegation and control and service optimization and strengthen policy support and public services for and market supervision over intellectual properties to establish fair, impartial, open and transparent legal and market environment for intellectual properties and promote mass entrepreneurship and innovation.
Adhere to overall arrangements. Arrange international and domestic innovative resources to form several leading intellectual property areas and cultivate China's advantage in intellectual properties. Enhance the global opening innovation and coordination, take an active part in and promote the formulation and improvement of the international rules on intellectual properties and establish a fair and impartial international economic order to create favorable conditions for the participation of market subject in international competition and achieve the quality improvement of imports and exports and mutual benefits.
(III) Main targets. By 2020, acquire decisive achievements from important fields and key links of intellectual property, further improve the system on authorization and confirmation and law-enforcement protection of intellectual property rights, basically form the intellectual property system and mechanism with clear rights boundary, rational division of labor, consistent responsibilities and authorities, efficient operation and legal guarantee, greatly promote the ability to create, apply, protect, manage and serve intellectual properties, further optimize the innovation and entrepreneurship environment, gradually form the new advantage in intellectual property of industry's participation in international competition, basically achieve the modernization of intellectual property governance system and capability, establish a group of powerful provinces and cities in terms of intellectual property industry and comprehensively consolidate the status of great power in intellectual property industry to lay a solid foundation for the establishment of a world-level great power in intellectual property industry with Chinese characteristics.
