The Provisions for Lawyers to Meet Criminals in Prison, adopted at the ministerial meeting of the Ministry of Justice on November 24, 2017, are hereby issued to you for your implementation.
Provisions for Lawyers to Meet Criminals in Prison
Article 1 With a view to safeguarding lawyers' practice rights and rights of criminals in prison, these Provisions are formulated in accordance with the Criminal Procedure Law of the People's Republic of China, the Prison Law of the People's Republic of China, the Law of the People's Republic of China on Lawyers, and other applicable provisions.
Article 2 A prison shall safeguard lawyer's rights to meet criminals in prison according to the law. While meeting criminals who are in jail, lawyers shall comply with provisions concerning the prison management.
Article 3 A prison shall announce in what ways lawyers could make an appointment for the meeting, and provide convenience for lawyers to meet with prisoners. Any lawyer's meeting with the criminal behind bars shall take place in the prison.
