Interim Measures for Consulting Real Estate Registration Materials

The Interim Measures for Consulting Real Estate Registration Materials which have been deliberated and adopted at the first executive meeting of the Ministry of Land and Resources on January 26, 2018 are hereby promulgated, and shall come into force as of the date of promulgation.

Chapter I General Provisions

Article 1The Measures are formulated in accordance with the Real Rights Law of the People's Republic of China, the Interim Regulations on Real Estate Registration and other laws and regulations, for the purpose of standardizing the activity of consulting real estate registration materials, strengthening the administration, protection and utilization of real estate registration materials, safeguarding the safety of real estate transactions, and protecting the legitimate rights and interests of the real estate right holders.

Article 2 For the purpose of the Measures, the real estate registration materials include:
1. the real estate register and other real estate registration results; and
2. original real estate registration materials, including application for real estate registration, materials concerning the identity of applicants, materials on the origin of real estate ownership, reasons for registration, investigation results of real estate right, and other materials that shall be examined and verified by real estate registration organs.
The real estate registration materials shall be kept and managed by real estate registration organs.

Article 3 Real estate registration organs of people's governments at or above the county level shall be responsible for the administration of consulting real estate registration materials.

Article 4 A real estate right holder or interested party may consult or copy real estate registration materials in accordance with the provisions of the Measures.
A real estate right holder or interested party may entrust the lawyer or other agents to consult or copy real estate registration materials.

Article 5 Consulting real estate registration materials shall follow the principles of legitimacy, convenience and efficiency.

Article 6 The real estate registration organ shall strengthen informationization construction of real estate registration, and based on the basic platform of real estate registration information management, provide convenience for inquirers through applying the internet technology, setting up self-service consulting terminals and registration information inquiry ports at relevant places and other ways.

Chapter II General Rules

Article 7 The real estate registration materials shall be consulted in the real estate registration organ of the municipal or county people's government in the place where the real estate is located, unless otherwise provided for by any law or regulation.
Where an inquirer applies for the consulting to non-local real estate registration organ, such organ shall inform the inquirer of going to the appropriate organ for consulting.
The real estate registration organ shall provide necessary sites for consulting, and arrange special persons in charge of the consulting and copy of real estate registration materials, issuance of the certificate of consulting results and other work.
In the case of the application for consulting the original real estate registration materials, priority shall be given to the retrieval of digitalized results.
