In order to strengthen the strategic planning and overall coordination of foreign aid and promote the unified management of work relating to foreign aid, the China International Development Cooperation Agency (the "CIDCA") was officially established and major reforms were carried out on the management system of foreign aid in accordance with the decision on deepening the reform of the party and state institutions approved at the Third Plenary Session of the 19th CPC Central Committee. Against this backdrop, the CIDCA formulates the comprehensive departmental rules on foreign aid, the Administrative Measures for Foreign Aid (Draft for Comment), which are hereby issued for public comments. The public may provide comments via the following means and methods:

1. Logging on to legal information portal of the Chinese government (http://www.chinalaw.gov.cn) and entering the column of "Collection of Comments on Legislation" in the main menu of the front page to offer comments.

2. Sending email to zcfgc@cidca.gov.cn.

3. Sending comments by mail to the Policy and Planning Division of the China International Development Cooperation Agency, No. 2 Yuetan Beixiaojie, Xicheng District, Beijing 100037, with the wording of "Seeking Comments on the Administrative Measures for Foreign Aid" indicated on the envelope.

The deadline for offering comments is December 12, 2018.

Administrative Measures for Foreign Aid (Draft for Comment)

Chapter I General Provisions

Article 1 These Measures are formulated in accordance with relevant laws and administrative regulations in order to strengthen the strategic planning and overall coordination of foreign aid, standardize foreign aid management, and enhance the effectiveness of foreign aid.

Article 2 For the purpose of these Measures, foreign aid refers to the activity that uses government foreign aid funds (hereinafter referred to as "foreign aid funds") to provide economic, technical, material, talent and management support to the recipients.

Article 3 Recipients of foreign aid mainly include developing countries that have established a diplomatic relation with the People's Republic of China and need to receive aid, as well as international or regional organizations mainly based on developing countries.
Under urgent or special circumstances such as humanitarian aid, a developed country or a developing country that has no a diplomatic relation with the People's Republic of China may become a recipient.

Article 4 Foreign aid shall be offered in a way respecting the sovereignty of recipients and without interfering in their internal affairs, and shall be designed to alleviate and eliminate the poverty of recipients, improve their livelihood and ecological environment, promote their economic development and social progress, enhance their capacity for self-development, consolidate and develop the friendships and cooperation with the recipients, and promote the implementation of the Belt and Road Initiative, the building of a new type of international relations featuring win-win cooperation and the development of a community of a shared future for all humankind.

Article 5 The China International Development Cooperation Agency (the "CIDCA") shall carry out centralized management of the work relating to foreign aid and shall be responsible for formulating strategic guidelines, plans and policies on foreign aid; drafting foreign aid laws and regulations and departmental regulations; coordinating major foreign aid issues and making suggestions related to it; coordinating foreign aid and emergency humanitarian foreign aid; studying and facilitating the reforms on means of giving foreign aid, studying the reform measures and promoting the implementation thereof; formulating foreign aid programs and plans; preparing the annual budget and final accounts for foreign aid; identifying foreign aid projects, supervising and evaluating the implementation thereof; organizing and carrying out international exchanges and cooperation on foreign aid.
All relevant departments (hereinafter referred to as the "executive department") shall assume specific assignments for the implementation of foreign aid according to division of work.
Chinese embassies and consulates (missions) shall assist the CIDCA in dealing with governmental affairs related to foreign aid, communicate with the recipients about the need for aid and carry out policy review, and take charge of overseas supervision and administration over the implementation of foreign aid projects.
