Provisions on the Registration Administration of Outdoor Advertisements (Revised in 2006)

The Provisions on the Registration Administration of Outdoor Advertisements, which have been amended in accordance with the decision of the executive meeting of the State Administration for Industry and Commerce of the People's Republic of China, are hereby promulgated and shall come into force as of July 1, 2006.

Appendix: Provisions on the Registration Administration of Outdoor Advertisements

Article 1 The present Provisions are formulated in accordance with the Advertising Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, the Regulation on the Administration of Advertisements and other laws and administrative regulations for the purposes of regulating the registration administration of outdoor advertisements and promoting the sound development of outdoor advertisements.

Article 2 The term "outdoor advertisements" as mentioned in these Provisions refers to the advertisements that are released by making use of outdoor sites, spaces and facilities.
The term "an outdoor advertisement releasing entity" as mentioned in these Provisions refers to an entity that release outdoor advertisements for others as well as an entity or individual that release outdoor advertisements for self promotion.

Article 3 In order to release outdoor advertisements, an outdoor advertisement releasing entity shall apply to the administrative organ for industry and commerce for registration, and be subject to the supervision and administration of the administrative organ for industry and commerce. Where it is prescribed in any law or regulation that administration and approval of the relevant department are required before registration, the entity shall go through the relevant administration and approval formalities.

Article 4 Outdoor advertisements shall be subject to the registration administration of the administrative organ for industry and commerce at or above the county level in the place of releasing outdoor advertisements.
The State Administration for Industry and Commerce shall be responsible for guiding and coordinating the registration administration of outdoor advertisements of the entire nation.
The administrative organ for industry and commerce of a province, autonomous region or municipality directly under the Central Government shall be responsible for guiding and coordinating the registration administration of outdoor advertisements within its jurisdiction.
The administrative organs for industry and commerce at the county level shall be responsible for the registration administration of outdoor advertisements within their respective jurisdiction.
If an organ for industry and commerce at or above the prefecture level (or a municipality directly under the Central Government) considers that direct registration administration of the outdoor advertisements within its jurisdiction is necessary, it may apply direct registration administration.

Article 5 In order to release any of the following outdoor advertisements, an outdoor advertisement releasing entity shall apply to the administrative organ for industry and commerce for outdoor advertisement registration, and obtain a Registration Certificate of Outdoor Advertisements:
