Measures for the Supervision and Administration of Security of the Postal Industry

The Measures for the Supervision and Administration of Security of the Postal Industry was adopted at the 11th Executive Meeting of the Ministry of Transport on December 23, 2010. It is now promulgated and shall come into effect as of February 1, 2011.

Measures for the Supervision and Administration of Security of the Postal Industry

Chapter I General Provisions

Article 1 For the purpose of enhancing the supervision and administration of security of the postal industry, maintaining the security of postal communication and information, protecting the legitimate rights and interests of postal users, and facilitating the healthy development of the postal industry, these Measures are hereby formulated in line with Postal Law of the People's Republic of China, relevant laws and administrative regulations.

Article 2 These Measures shall be applicable to the administration, operation and use of postal services and courier business as well as relevant security activities within the territory of China.

Article 3 Supervision and administration of the security of the postal industry shall be conducted in line with the principle of "security first, precaution crucial and comprehensive control" so as to guarantee the availability of the postal delivery channels and the security of mails, express consignments and ensure the the production security of postal enterprises and courier companies, and the personal safety of people working in the postal industry.

Article 4 The postal administration department of the State Council shall be responsible for supervising and administering the security of the postal industry of China.
The postal administration departments of all provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for supervising and administering the security of postal industry in their corresponding administrative region.

Article 5 Postal administration departments shall cooperate with relevant authorities, improve the postal security safeguarding mechanism and enhance supervision and administration of the postal communication and information security.

Article 6 Postal enterprises and courier companies shall comply with the provisions of the State on security administration, shall not jeopardize state security, public security and the legitimate rights and interests of citizens, legal persons and other organizations.

Article 7 When sending items by ordinary mail and express mail, postal users shall comply with relevant regulations on items prohibited or restricted from postal delivery, and shall not jeopardize state security, public security and the legitimate rights and interests of citizens, legal persons and other organizations through the postal delivery channel.

Article 8 No citizen, legal person and other organization may conceal, destroy, discard and illegally open ordinary mails and express mails, nor damage and destroy postal and courier service facilities, or affect the normal operation of postal and courier service facilities.
Relevant citizens, legal persons or other organizations shall cooperate with postal administration departments in their supervising and administering the security of the postal industry.

Chapter II Communication and information security

Article 9 Postal enterprises and courier companies shall remind customers to faithfully fill in the form of postal delivery details including the names and addresses of the senders and recipients and the names, categories and quantity of the postal articles, verify the information about the senders and recipients, and accurately mark the weights of and fees for relevant ordinary mails and express mails. Where the postal administration department of the State Council requires that senders produce their ID certificates, postal enterprises and courier companies shall require customers to produce their valid ID certificates.
Postal enterprises and courier companies shall check the postal articles in the presence of the customers so as to decide whether or not the postal articles belong to items prohibited or restricted by the State from postal delivery. They shall also check to see if the names, categories and quantity of the postal articles have been faithfully written down on the form of postal delivery details. Where relevant customers shall produce relevant written evidences in line with relevant regulations of the state, postal enterprises and courier companies shall require the customers to produce original evidence and shall accept and mail the articles in question after conducting verification and finding no errors.
Where the customers refuse to accept postal article checking, faithfully fill in the form of postal delivery details , provide relevant written evidence or produce valid ID certificates in line with relevant regulations, postal enterprises and courier companies shall not accept and mail the relevant articles.

Article 10 Where postal enterprises and courier companies find, in the process of accepting and mailing postal articles, that customers mail articles prohibited by the State from postal delivery, the postal enterprises and courier companies shall refuse to accept and mail the articles. Where the aforesaid articles are found in the ordinary mails and express mails which have been accepted and mailed, the postal enterprises and courier companies shall immediately stopped forwarding and delivering the articles.
Where any articles thereof need to be confiscated or destroyed in line with the law, the postal enterprises or courier companies shall immediately report to relevant departments and cooperate with the departments in disposing of the articles.
For articles which are prohibited from postal delivery but need not to be confiscated or destroyed, or articles investigated at the same time therewith other than those prohibited from postal delivery, the postal enterprises and courier companies shall contact the senders or recipients and properly handle such articles.

Article 11 Courier companies shall not engage in letter postal delivery business which are exclusively operated by postal enterprises, and shall not mail and deliver the official documents of state organs.
