The Decision of the State Council on Revising and Repealing Certain Administrative Regulations is hereby published, and shall come into force as of the date of publication.

Decision of the State Council on Revising and Repealing Certain Administrative Regulations

In order to promote the reform of streamlining administration, delegating powers, improving regulation and optimizing services in accordance with the law, the State Council has sorted out the administrative regulations involved in the cancelation and delegation of administrative licensing items as well as those no longer applicable in practice. Upon doing so, the State Council has decided to:

I. Revise some clauses of seven administrative regulations. (Appendix I)

II. Repeal ten administrative regulations. (Appendix II)

The Decision shall come into force as of the date of publication.

Appendix I: Administrative Regulations Revised by the Decision of the State Council

I. The "building of any artificial fish reef outside the 'bottom trawl no-fishing zone line for motor fishing vessels' shall be approved by the competent administrative department of fishing under the State Council" as specified in Paragraph 1 of Article 22 of the Implementing Rules of the Fisheries Law of the People's Republic of China shall be deleted.

II. Item 1, Paragraph 1 of Article 35 of the Regulations on Urban Water Supply shall be deleted. Paragraph 2 shall be revised to read: "Where any party commits any of the acts set out in Item 1, 3, 4, 5 or 6 of the preceding paragraph and the circumstances are serious, water supplies may, upon approval by the people's governments at or above the county level, be suspended for a certain period of time."

III. Item 3 of Article 8 of the Administrative Regulations on Urban Real Estate Development and Operation shall be deleted.

IV. Paragraph 1 of Article 10 of the Regulations on Administration of Weather Modification shall be revised to read: "Entities engaged in weather modification operations shall provide pre-job training for persons engaged in weather modification operations according to the training standards for persons engaged in weather modification operations formulated by the competent meteorological department under the State Council. Persons engaged in weather modification operations may not implement such operations until they have grasped the relevant operation regulations and procedures."
Paragraph 2 of Article 13 shall be revised to read: "Relevant departments in charge of agriculture, villages, water conservancy, forestry and grassland shall, without delay and free of charge, provide data relating to the status of disasters, hydrology, fires, etc.
